Lead LinQ provides customer relationship management (CRM) and automation solutions to help businesses streamline operations, increase client retention, and improve client satisfaction. These Terms govern your use of Lead LinQ’s software, services, and features (the "Services"). Lead LinQ is owned and operated by Limitless Enterprise Solutions Pty Ltd (ACN 676 566 760). All references to Lead LinQ include all related applications, dashboards, platforms, and websites operated by Lead LinQ.

This Terms of Service Agreement ("Terms", "Terms of Service", or "Agreement") constitutes a legally binding agreement between you ("Client", "you", or "your") and Limitless Enterprise Solutions Pty Ltd ("Lead LinQ", "we", "us", or "our") for the provision of Services.

By accessing or using the Services, or by clicking “I Agree”, you acknowledge that you have read, understood, and agreed to be bound by these Terms without limitation or qualification. If you do not agree to these Terms, you must not access or use the Services. If you are acting on behalf of an entity, you represent and warrant that you are authorised to bind the entity to this Agreement.

Your continued use of the Services will constitute acceptance of any amendments.

You acknowledge and agree that Lead LinQ is not the developer or owner of the underlying software platform used to deliver the Services. The Services are powered by third-party infrastructure, including but not limited to Go High Level. Lead LinQ acts solely as an intermediary, configurator, reseller, and service provider. We do not control or operate the underlying software systems, infrastructure, or telecommunications networks. To the maximum extent permitted by law, all responsibility for the operation, performance, availability, security, and reliability of the platform rests with the relevant third-party provider. You agree that any defects, outages, data loss, delays, or failures caused by such third-party platforms are outside of our control and responsibility.

Our Services

Scope

We provide CRM, website and funnel design, automation, and advertising services through Lead LinQ. Specific Services available to you may vary over time.

No Guarantee

We do not guarantee any particular results, outcomes, revenues, client acquisition, or business performance from using the Services.

Temporary Interruptions

You acknowledge that temporary interruptions of the Services may occur. Services rely on third-party platforms, telecommunications networks, and infrastructure providers. We are not liable for any delays, interruptions, loss of data, system outages, or failures caused in whole or in part by third-party providers. Services are provided “as is” and “as available” and we assume no responsibility for timeliness, deletion, mis-delivery, or failure to store any data, communications, or personalisation settings.

Service Modifications

We may modify, enhance, suspend, or discontinue any part of the Services at our sole discretion without notice, including where such changes are required due to third-party platform changes.

No Future Commitments

Purchase of Services is not contingent on the delivery of any future features, upgrades, releases, or enhancements.

Unlimited SMS

At Lead LinQ, we provide you with the ability to send SMS communications to your customer database. You acknowledge that message delivery is dependent on third-party providers and telecommunications carriers, and we make no guarantees regarding delivery rates, timing, or reliability.

Your Responsibility

You are solely responsible for all communications sent using the platform. For the purposes of applicable law, including the Spam Act 2003 (Cth), you are deemed to be the sender of all communications. You are solely responsible for content, timing, recipients, consent, and compliance with all applicable laws. Lead LinQ does not create, review, monitor, or approve your communications unless separately engaged for paid Campaign Management services.

Campaign Management

Where you engage us for Campaign Management services, we may assist with messaging; however, you remain fully responsible for the legality of your data, consent obtained, and communications. Any assistance provided does not constitute legal advice.

Consent Requirements

You must obtain and maintain valid, informed, and verifiable consent for all communications.

Opt-Out Compliance

You must ensure opt-out functionality is active and honoured. We are not responsible for any modification, disabling, or removal of opt-out systems.

Prohibited Content

You must not send unlawful, misleading, deceptive, abusive, or prohibited content. You are solely liable for all content transmitted.

System Abuse

We reserve the right to monitor usage and suspend or terminate accounts for misuse without liability.

Liability Disclaimer

You agree to indemnify Lead LinQ against any claims, fines, damages, penalties, or losses arising from your use of the platform, including regulatory breaches, third-party claims, and misuse.

Fees and Payments

Set Up Fee

Any set up fee is non-refundable.

Subscription Fees

You agree to recurring billing. You authorise us and our payment providers to charge your payment method automatically. All payment obligations continue until cancellation is properly effected.

Failed Payments

We may suspend services and recover all associated costs, including legal and debt recovery costs.

Fee Changes

We may increase fees with notice. Continued use constitutes acceptance.

GST and Currency

All fees are in AUD and exclusive of GST.

Term, Renewal and Termination

Automatic Renewal

Subscriptions automatically renew unless cancelled with at least 14 days written notice.

Cancellation by Client

All payments are non-refundable.

Termination by Lead LinQ

We may terminate or suspend access at any time, with or without cause, without liability or obligation to refund.

Client Obligations

You must comply with all laws and not misuse the Services. You are responsible for all activity under your account.

You must not reverse engineer, copy, scrape, or exploit the platform.

Accounts are non-transferable.

Intellectual Property

All intellectual property remains our property. You are granted a limited licence only. You are responsible for all content you upload or create.

Third Party Services

The Services rely on third-party providers, including Go High Level. You acknowledge that:

We do not control or guarantee third-party services.

We are not responsible for outages, failures, delays, data loss, or changes made by third parties.

If third-party services are modified, suspended, or discontinued, we may modify or discontinue the Services without liability.

You are not entitled to refunds, credits, or compensation arising from third-party failures.

You agree that any issues arising from third-party platforms must be directed to those providers.

Disclaimers and Limitations of Liability

The Services are provided “as is” and “as available” without warranties of any kind.

To the maximum extent permitted by law, Lead LinQ excludes all liability for any loss, including loss of profits, revenue, data, business opportunity, goodwill, or reputation, whether direct or indirect.

You acknowledge that use of CRM and automation systems carries inherent risks, including errors, data loss, and system failures, and you assume all such risks.

Our total aggregate liability is limited to the lesser of one month of fees paid or AUD $100.

No Reliance

You acknowledge that you have not relied on any representations outside of this Agreement. Any marketing or sales materials are illustrative only.

Indemnity

You agree to fully indemnify and hold harmless Lead LinQ, its directors, employees, and affiliates from any claims, damages, losses, liabilities, penalties, fines, and expenses (including legal costs on a full indemnity basis) arising from:

Your use or misuse of the Services

Your breach of any laws

Your communications and content

Your data and customer lists

Any third-party claims

Any reliance on automations or workflows

This indemnity survives termination.

General

Governing Law

This Agreement is governed by the laws of Western Australia.

Force Majeure

We are not liable for events beyond our control.

Entire Agreement

This Agreement constitutes the entire agreement.

Amendments

We may update these Terms at any time.

Severability

Invalid provisions do not affect the remainder.

Assignment

You may not assign without consent.

Use of your name, logo and marks

You consent to us using your name and logo unless you opt out in writing.

Electronic Communication

You agree to receive communications electronically.

Privacy & Security

Your use of the Services is subject to our Privacy Policy.

You acknowledge that authorised personnel, including third-party providers such as Go High Level, may access account data for support and technical purposes.

Warranties, Limitation of Liability and Indemnity

To the fullest extent permitted by law, you use the Services entirely at your own risk. We disclaim all responsibility for third-party systems, platforms, and services. You waive any claims against us arising from third-party failures and agree that such claims must be directed to the relevant third-party provider.
